Federal Judge Orders Freedom of Abrego Garcia from Immigration Custody

Legal scene

A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to face human smuggling charges, he was held in immigration custody.

In her decision, the court noted that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Background of the Case

The court challenge involve conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.

Terms of Release

The judge, who was overseeing his petition to removal in a federal court, determined that he must now adhere to the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.

This ruling represents a notable development in a complicated immigration battle involving claims of wrongful detention and contested criminal associations.
